Judge Denies Motion, No Jail Time For John Ludwig, Jr.

John Ludwig, Junior will stay out of prison after a court hearing Friday morning in Greenville.
Judge James Williams, Jr. has denied a motion by the 13th Circuit Solicitor to reconsider the sentence against Ludwig, Jr. for a reckless homicide conviction Friday morning in a Greenville court.
He was sentenced to three years probation - and no jail time - after pleading guilty to the charge previously.
Ludwig pleaded guilty Friday to assault and battery high and aggravated in a separate burglary charge against him. Judge Williams sentenced Ludwig, Jr. to five years in prison that was reduced to three years probation.

Bengy Brown, the victim in the assault and battery case, told the judge how scared he was the night Ludwig broke in his apartment in July of 2008. Brown was romantically involved with Ludwig's ex-wife at the time.
"It was clear that he wasn't there to talk to me. He was there to hurt me," said Brown in open court. He claimed Ludwig has not followed his bond at all. Brown says Ludwig contacted him over 50 times and offered to pay him for dropping charges.
Brown says his life is "forever changed" by what Ludwig did.
Ludwig's attorney says it started because his client discovered his wife was having an affair with Brown. Ludwig says he found evidence of the affair and tried to approach his ex-wife and Brown about it.
Ludwig was sentenced after pleading guilty to reckless homicide in the death of Frederic Bardsley of Greenville. Bardsley was killed April 25 after Ludwig's Maserati hurtled through a field, launched off an embankment and plowed into the back of Bardsley's home.
Ludwig's attorneys say he lost control after swerving to miss deer.
13th Circuit Solicitor Bob Arial released a statment Friday, saying his office is satisfied that the judge seriously considered their motion, and they he accepts the ruling. As for the decision to allow Ludwig to plead guilty on the Assault charge, Arial said he believed it more accurately reflected the nature of the crime.

John Ludwig pleaded guilty to reckless homicide in a Greenville courtroom Monday morning, but will serve no jail time.
Judge Judge James C. Williams Jr. sentenced Ludwig to five years probation, suspended to three years probation. Ludwig must also serve 500 hours of community service.
The 13th Circuit Solicitor's Office recommended the maximum sentence of 10 years in prison for Ludwig on this reckless homicide charge. The murder charge against Ludwig has been dismissed.
Solicitor Bob Ariail said the following after the sentencing of John Ludwig: "We strongly believed, as an advocate, that Mr. Ludwig deserved an active prison sentence and urged the Judge to impose the maximum ten year sentence. We were shocked at the sentence imposed. However, Retired Judge James Williams, who was specifically appointed by the Chief Justice to handle this case, is ultimately responsible for determining the proper punishment. He considered everything we presented and made his decision, and I have no doubt he fairly and thoroughly considered the evidence and imposed the sentence he felt was correct."
Solicitor Bob Ariail says DNA on the airbag of the Maserati confirms Ludwig was behind the wheel in April when his car crashed into the home of Frederic Bardsley in Travelers Rest. Ariail says Ludwig was the only person in the vehicle.
In court, Ariail says the chief legal counsel of SDI, Ludwig's former company, was traveling in front from of Ludwig when Ludwig passed him on the left pulled in front of him and went off the right side of Roe Ford Road. The posted speed limit is 35 miles per hour and is posted no passing.
Ariail says experts determined Ludwig was traveling at least 85 miles an hour when the accident happened.
Ariail says in court that Ludwig has 24 traffic citations - most cited as speeding by Ariail - since 1992. Ludwig's attorney says all but two of the speeding violations were 10mph above the posted limits for those offenses.
Ludwig's attorney says alcohol or drugs did not play a role in what happened when he crashed his car into the Bardsley home on on April 25, 2009. The defense introduced several witnesses to address the character of Ludwig before Judge Williams Jr.
Ludwig's family and friends were in court to testify to Ludwig's character.
Police say Ludwig was driving more than 85 mph and lost control of his Maserati April 25. The car sped across a field before plowing into the back of 62-year-old Frederic Bardsley's home. Bardsley was killed. His wife, who was upstairs, was unhurt, and Ludwig suffered minor injuries.

ANDERSON, S.C. -- Deputies need your help to identify and find four people wanted for fraud. Today, they released surveillance photos of the people in question.
Three of them are women, wanted for using stolen debit and credit cards at retail stores in Anderson.
The credit and debit cards were stolen from cars parked in the City of Anderson. Deputies say the women tried to use the cards at Target and Best Buy on Clemson Boulevard between November and December.
Deputies are also on the lookout, for a man, they say, tried to commit prescription fraud at a Piedmont CVS. Investigators say the man presented a fake ID to try and get the prescription. He was unsuccessful.

SIMPSONVILLE, SC -- The Greenville County Sheriff's Office is looking for a man wanted in connection with a burglary at a Dollar General store in Simpsonville.
Master Deputy Laura Campbell of the sheriff's office said that a man broke into the Dollar General at 2310 West Georgia Road after the store had closed on Thursday. After entering the store, the man went through and took various items valued at $49.
The man is described as a white male with a bald or shaved head, between 19-to-25 years old, 5'8" to 5'10" and weighing approximately 180-to-200 pounds. If anyone has any information about the suspect's identity, they are asked to contact the Greenville County Crime Stoppers at 23-CRIME.

FOUNTAIN INN, S.C. -- Laurens County deputies say they arrested a Fountain Inn man after an ongoing investigation of explosions in the Gentry Road area.
Deputies say 39 year old Scott Everett Kraft was arrested Friday after hearing about several explosions. They found those explosions were occurring on Kraft's property.
After deputies and SLED's Bomb Squad got a search warrant, they found materials to make improvised explosives on the property.
Kraft faces two counts of manufacturing an improvised explosive device.
He was booked into the Johnson Detention Center and is waiting a bond hearing.

SPARTANBURG, SC -- A man is in custody after authorities say he robbed a bank in Spartanburg County Friday afternoon.
Spartanburg County Sheriff's Office investigators charged 35-year-old Phillip Norman Pontnak, of Charlotte, North Carolina, with bank robbery.
Master Deputy Kevin Bobo of the sheriff's office stated that deputies responded to First Piedmont Federal Bank, located at 2101 Boiling Springs Highway in Boiling Springs, at 2:45 p.m. Friday afternoon. According to Bobo, deputies met with a teller at the bank who stated that a man came in the bank and handed her a note demanding money. As the man left the bank, Bobo said that a bank manager saw the man get into a beige, four door Toyota Corolla with a North Carolina license tag.
Deputies in Spartanburg County discovered that the car the suspect was driving was registered to his father-in-law. The information was relayed to North Carolina authorities. Officers with the Charlotte-Mecklenburg Police Department went to address where the car was registered to and spoke with Pontnak's father-in-law, who provided them with his name.
Charlotte-Mecklenburg Police officers spotted Pontnak driving the same vehicle at the intersection of Providence Street and McGee Street in the city limits. They conducted a traffic stop where they found the same coat that Pontnak was allegedly wearing in the back seat of the car, and it appeared he had shaved his mustache and goatee as he drove from Spartanburg to Charlotte.
Bobo said that Pontnak did not threaten the teller or display a weapon during the robbery.
Charlotte-Mecklenburg Police have charged Pontnak with driving under suspension. He is currently being interviewed by Charlotte-Mecklenburg Police officials and will be booked into their jail afterwards.
